Appellate Practice

Attorneys in the firm not only fully litigate our clients’ cases through trial, we take cases to the next level, appellate courts. In addition, clients directly engage the firm to handle appeals, even when another law firm served as trial counsel. In either circumstance, members of the firm have the experience and knowledge necessary to ensure that our clients have the opportunity to have their cases heard in every forum available to them.

Our firm handles all aspects of the appellate process, often beginning by identifying and preserving potential appellate issues while the case is still at trial. After trial, we rationally address and discuss the merits and likelihood of success of an appeal and analyze the cost-effectiveness of seeking such relief with our clients to ensure that they are fully informed. We also advise on federal or state court appellate jurisdiction and procedure.

Once a notice of appeal is filed, attorneys in the firm fully research all potential issues and draft appellate briefs on the merits. When the appellate court so requests, our firm’s attorneys are skilled and effective at presenting oral arguments. We are also fully versed in appellate procedures and practices and prepare and present petitions for rehearing, writs for certiorari, and make motions for other extraordinary relief.

Our firm’s appellate practice is invaluable to our ability to thoroughly protect our clients’ interests and provide the best representation possible. Attorneys in our firm are admitted to practice before the South Carolina Court of Appeals, the South Carolina Supreme Court, the United States Court of Appeals for the Fourth Circuit, and the United States Supreme Court.
